He wouldn't need to sue the tackler. The tackle wasn't really that bad honestly. It was not as if the defender targeted the head.
What was bad was that in the Big12 CG he had concussion-like symptoms. He was allowed to stay in the game. Later he was assessed and allowed to return. Before ultimately getting removed when it was apparent he was struggling.
Then even though he had really horrible post-concussion issues throughout December he is cleared to play in a bowl game.
The one his family should try to sue is Baylor.
Baylor - for their questionable on-field concussion assessment
Baylor - for whatever is their protocol for off-field in game concussion assessment
Baylor - for their after game concussion protocol
Baylor - for clearing him to play football on Jan 1 rather than allowing him several more weeks to recover.
He had a concussion in an earlier game in the season. It was not publicly disclosed which hit was the problem in that game, but in that game too he played after the likely hit(s) in question.
Also, FWIW - Why do I know this much about his health? Baylor press releases and news conferences... Sue Baylor for HIPAA disclosures too, as I have doubts that the guy in the dark room unable to remember what happened was in any position to consent to the release of health information Baylor presented to Texas media in mid-December.
