The privacy of student athletes is doubly protected.  HIPPA is the 20+ year old health privacy act, FERPA is the 40+ year old student privacy act.  I'm not a lawyer but it seems to me as if both have been featured much more prominently at my university in recent years.  My guess is that caselaw has grown and developed and universities are doing a much more comprehensive job of enforcing student privacy than they did a while ago.
