There are important differences here:

1. Shumer was not talking at a time when an actual vacancy existed.
2. Shumer left open the possibility for "extraordinary circumstances."
3. Shumer says he would have at least heard
3. Shumer was not Senate Majority Leader, and therefore did not have control over the calendar.
